Hawks / Ntlemeza

The Directorate for Priority Crimes Investigation (DPCI - also known as the Hawks), is a key component in the administration of justice. Integrity within the Hawks, especially its leadership, is essential.

Intro

The HSF and FUL launched proceedings with against the Minister of Police and Lt-Gen Ntlemeza in March 2016.  In the application, the Court was asked to review a decision made by the Minister to appoint Lt-Gen Ntlemeza as the National Head of the DPCI.

In March 2017, the Court set aside the Minister’s decision, on the grounds that Lt-Gen Ntlemeza was unfit for this position, given the fact that other Courts had found that he lacked integrity and had lied on oath.  The Minister had been aware of this fact, but had omitted to put the full facts before the panel that had decided to appoint him. 

Lt-Gen Ntlemeza appealed to the Supreme Court of Appeal (SCA).  The SCA dismissed the appeal.  The Constitutional Court was then petititioned by Lt-Gen Ntlemeza’s to hear his appeal, but the Constitutional Court declined the application.
