Press Release: HSF In The High Court In An Application To Review The National Commissioner Of Correctional Services’ Decision To Place Jacob Zuma On Medical Parole

The Helen Suzman Foundation (“HSF”) Will Be Litigating In The Pretoria High Court Today In An Application To Review The Then-National Commissioner Of Correctional Services, Arthur Fraser’s, Decision To Place Mr Zuma On Medical Parole.

Following his imprisonment for contempt of court, former President Jacob Zuma was placed on medical parole by the then-National Commissioner of Correctional Services, Arthur Fraser. The HSF has subsequently approached the Pretoria High Court for an order declaring this decision unconstitutional and unlawful and setting it aside.

It is the HSF’s case that the National Commissioner’s decision to release Mr Zuma on medical parole is unconstitutional and unlawful as, in terms of the relevant legislation and regulations, the National Commissioner does not have the power to overrule the Medical Parole Advisory Board that did not recommend that Mr Zuma be placed on medical parole.

The HSF’s Founding Affidavit can be found here.

The HSF’s Heads of Argument can be found here.
